Terms of Service

Effective April 16, 2026

These Terms of Service (“Terms”) govern your use of the Novi mobile application and related services (the “Service”) operated by Abhinav Gadudasu (“we”, “us”, “our”). By creating an account or using the Service, you agree to these Terms.

1. Account Terms

  • You must be at least 13 years old to use the Service.
  • You are responsible for maintaining the security of your account credentials.
  • You may not use another person's account without their permission.
  • You must provide accurate information when creating your account.
  • One person may maintain only one account. Creating multiple accounts to circumvent restrictions is prohibited.

2. User-Generated Content

The Service allows you to post content including book comments, profile information, and other material (“User Content”). You retain ownership of your User Content, but grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute it within the Service.

Content standards

We maintain a zero-tolerance policy for objectionable content. You may not post User Content that:

  • Is abusive, harassing, threatening, or promotes violence.
  • Contains hate speech or discriminates based on race, ethnicity, gender, sexual orientation, religion, disability, or national origin.
  • Is sexually explicit or pornographic.
  • Promotes illegal activities or substances.
  • Infringes on intellectual property rights of others.
  • Contains spam, phishing, or malware.
  • Impersonates another person or entity.
  • Is otherwise objectionable or inappropriate.

Content moderation and reporting

Users can report objectionable content directly within the app. We review all reports and will act on them promptly. Actions may include:

  • Removing the reported content.
  • Issuing a warning to the offending user.
  • Suspending or permanently terminating the offending user's account.

We reserve the right to remove any User Content and terminate any account at our sole discretion, without prior notice, if we determine that the content or conduct violates these Terms.

3. Prohibited Conduct

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws.
  • Attempt to gain unauthorized access to any part of the Service or its related systems.
  • Interfere with or disrupt the Service or servers/networks connected to it.
  • Use automated means (bots, scrapers, etc.) to access the Service without our written permission.
  • Collect or harvest personal information of other users without their consent.
  • Use the Service to send unsolicited communications or spam.

4. Intellectual Property

The Service, including its design, features, and original content (excluding User Content), is owned by us and protected by copyright, trademark, and other intellectual property laws. Book metadata and cover images are provided by third-party sources (Hardcover) and remain the property of their respective owners.

5. Termination

You may delete your account at any time from Settings → Delete Account. We may suspend or terminate your account at any time for violations of these Terms, without prior notice.

Upon termination, your right to use the Service ceases immediately. We will delete your data in accordance with our Privacy Policy.

6. Third-Party Services

The Service integrates with third-party services (authentication providers, analytics, etc.) as described in our Privacy Policy. We are not responsible for the practices or content of third-party services.

7. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or secure. Book recommendations are generated using a combination of techniques including machine learning and may not always reflect your preferences.

8. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

  • Your use of or inability to use the Service.
  • Any unauthorized access to or use of our servers and/or any personal information stored therein.
  • Any User Content posted by other users of the Service.

9. Indemnification

You agree to indemnify and hold harmless Abhinav Gadudasu and the Service from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, your User Content, or your violation of these Terms.

10. Dispute Resolution

Any dispute arising out of or relating to these Terms or the Service shall first be addressed through good-faith negotiation. If the parties cannot resolve the dispute informally within 30 days, either party may pursue binding arbitration under the rules of the American Arbitration Association (AAA), conducted in San Francisco, California. You waive any right to participate in a class-action lawsuit or class-wide arbitration. Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction for claims involving intellectual property or unauthorized access.

11. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions.

12. General Provisions

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service. Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms here and updating the effective date above. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
